What do I do if I notarize for a mother and daughter with the same name?

I am notarizing the signatures of a mother and daughter with exactly the same name. Is it acceptable to add the daughter’s DOB on her Notary acknowledgment to specifically identify her? For example: “… personally appeared JANE SMITH DOE (DOB: 1/1/1990) …” We are creating separate trusts for each of them and separate grant deeds for one property to go to each of their trusts. — N.D., California

That’s a great question. We recommend not including the daughter’s date of birth in her name on the notarial certificate. Your duty as a Notary is to simply verify the identities of the signing parties. While it is unusual for two signers to have the exact same names, your journal entry for each notarial act will include separate lines that note the specific form of identification you used to identify them. Their signatures on the document and in your journal will also differ, which will show that the two were not the same individual.

Hotline answers are based on the laws in the state where the question originated and may not reflect the laws of other states. If in doubt, always refer to your own state statutes. – The Editors
