Can I notarize if I use Zoom to contact the signer?

Can a California Notary perform a Zoom or Docusign notarization for an Arizona resident when each person is in their own state? — T.B., California

No, you may not perform a notarial act over Zoom in California. We’re not sure exactly what you mean by a “Docusign” notarization, so we cannot comment on that. Current California law requires signers requesting notarial acts to appear physically before the Notary at the time of notarization. In a couple of years, California Notaries will be able to perform online notarial acts. For more information, please see our article on California’s remote notarization law, which is not expected to take effect until at least 2030.

For information on remote online notarization rules for other states, please see our Remote Online Notarization resources page in the NNA Knowledge Center.

Hotline answers are based on the laws in the state where the question originated and may not reflect the laws of other states. If in doubt, always refer to your own state statutes. – The Editors
