I need to know if I am able to notarize a trust that I am a beneficiary of? — E.R., Indiana

No, you may not notarize the trust (IC 33-42-13-3[a][10]). Being a beneficiary of a trust means you will stand to gain financially or beneficially from the trust. You can no longer be an objective and impartial Notary.

For more information, please see our article on conflicts of interest that disqualify Notaries from notarizing.

Hotline answers are based on the laws in the state where the question originated and may not reflect the laws of other states. If in doubt, always refer to your own state statutes. – The Editors
