Can I accept a voter ID card as proof of a signer's identity?

Is a voter ID card a valid form of signer identification, and does it make any difference whether or not the signer is in hospice care when determining if they are mentally alert?V.O., Mississippi

The answer to your first question is yes. A Mississippi Voter ID card is a valid form of identification under Mississippi law (MCA 25-34-13[2]).  The answer to your second question is no. If the signer is in hospice care, you may proceed with the notarization as long as you can confirm that the signer is aware, understands the document and its implications, and is signing willingly.

Notaries in other states have different rules and guidelines for acceptable proof of a signer's identity. For more information, please see our guidelines for accepting or rejecting signer identification.

Hotline answers are based on the laws in the state where the question originated and may not reflect the laws of other states. If in doubt, always refer to your own state statutes. – The Editors
