May I Notarize A Translated Foreign Birth Certificate?

New Hotline Resized 3My co-worker wants me to notarize an English translation of a Japanese birth certificate. Can I do it?K.P., California

It’s unclear from your question exactly what you are being asked to do, but there are two possibilities. First, your co-worker may want you to certify that the English translation of the Japanese birth certificate is accurate. Under California law you are not permitted to certify the accuracy of a translation because it isn’t considered an authorized notarial act. Second, your co-worker may want you to notarize a declaration signed by the translator of the Japanese birth certificate stating that the translation is accurate. This you can do, because you are notarizing the signature of the translator on the declaration.

Hotline answers are based on the laws in the state where the question originated and may not reflect the laws of other states. If in doubt, always refer to your own state statutes. – The Editors
