A client of mine said his wife does not have a driver’s license but does have a Mexican passport. Is this acceptable ID?E. F., Wisconsin

In the state of Wisconsin, you can accept a foreign passport which is current or expired not more than 3 years before performance of the notarial act (WS 140.007[2][a][1]).

Information on ID requirements for Notaries in other states can be found in The National Notary Bulletin article, “Notary guidelines for accepting or rejecting a signer’s ID.”

Hotline answers are based on the laws in the state where the question originated and may not reflect the laws of other states. If in doubt, always refer to your own state statutes. – The Editors

Oklahoma Notary here, can notaries in this state accept foreign IDs? (most commonly here, a Mexican Passport or Matricula Consular)

Hello. Oklahoma does not specify what types of ID are acceptable for notarization. However, the Oklahoma Secretary of State's website says the following: "A notary public identifies a signer by carefully examining the identification presented and comparing the signature the person has made on the document with the signature on the identification. The notary public may also rely on their personal knowledge of the individual. Proper “ID” should include a photograph and signature, such as a driver’s license or passport. It is also considered sufficient identification if, under oath, a credible witness personally known to the notary public identifies the person."

Hello. Texas Notaries may only accept a current foreign passport as proof of signer identity when the notarization involves a deed or other instrument relating to a residential real estate transaction (1 TAC 87.1[1]).
