Online immigration forms course offers resources for professionals and applicants

Immigration-Stock-Resized.jpgThe NNA’s new online course “How To Prepare Immigration Forms” provides helpful training for those looking to provide immigration forms services as well as resources for applicants seeking information about important immigration forms encountered during the visa and citizenship process.

Developed with the expertise of practicing immigration attorneys, the eLearning course provides information about
several important U.S. Citizenship and Immigration Services (USCIS) forms that must be submitted by applicants, including the following:

  • Form I-130 (Petition For Alien Relative)
  • Form I-485 (Application To Register Permanent Residence Or Adjust Status)
  • Form N-400 (Application For Naturalization) 

If you are interested in providing immigration forms services, remember that you must comply with any state laws regarding any registration requirements and service limitations, and avoid offering unauthorized legal advice or services. The course also provides guidance for when immigrants should seek the help of a qualified immigration attorney.

I would like to understand the florida statutes... as a notary public what am I aloud to do in Florida. I worked 30 years with an Immigration attorney, have much experience and do not want to be accused of unauthirized practice of law

Hello. "A Florida notary public who is not an attorney who advertises the services of a notary public in a language other than English, whether by radio, television, signs, pamphlets, newspapers, or other written communication, with the exception of a single desk plaque, shall post or otherwise include with the advertisement a notice in English and in the language used for the advertisement. The notice shall be of a conspicuous size, if in writing, and shall state: ‘I AM NOT AN ATTORNEY LICENSED TO PRACTICE LAW IN THE STATE OF FLORIDA, AND I MAY NOT GIVE LEGAL ADVICE OR ACCEPT FEES FOR LEGAL ADVICE.’ If the advertisement is by radio or television, the statement may be modified but must include substantially the same message" (FS 117.05[10]).

I would like to understand the Massachusetts statutes... as a notary public what am I aloud to do or not to do, other than not advertise and translate Notary into NOTARIO. I am a notary public for the state of MA, but not making business of it yet; I had been helping family and friends preparing immigration forms before getting my Notary Stamp. I can’t find anything regarding any registration requirements and service limitations, serving specifically as preparer form only, not a consultant. Could you advise, Thanks.

When you do an immigration form , do you sign it as a preparer ? or just leave as is? I already have my certificate.

Notaries who wish to offer non-legal assistance with immigration forms must be careful to comply with all state rules regarding these services. Some states prohibit Notaries from offering any services related to immigration documents, while others have additional restrictions and requirements regarding qualifications and advertising.
