Hotline Tip: Do Witness Signatures Require Notarization?

When notarizing a power of attorney, do the witness signatures also need to be notarized? Also, do I charge only for the signature being notarized, or should I also charge for the witnessing of the witness signatures? - B.B., Hawaiian Gardens, CA

When witnesses appear in front of a Notary, the Notary must ask the witnesses and/or the signers, if the witnesses’ signature(s) need to be notarized or not, as the Notary may never make such a determination. If the appearing parties of the transaction are not certain, they would need to speak to the receiving agency.

The Notary may only charge for the witnesses if they need their signature(s) notarized.
