Summary

New rules issued by the Tennessee Department of State implement the new training requirement for Online Notaries enacted by House Bill 1051, effective January 1, 2026.

Affects

Amends Rule 1360-07-03-.02 of the Rules and Regulations of the State of Tennessee.

Changes
  1. Requires applicants for an Online Notary Public commission to certify that they have reviewed, understand, and will comply with the requirements of the Online Notary Public Act (TCA §§ 8-16-301, et seq.) and the Department’s Online Notary Public Rules.
  2. Requires applicants for an Online Notary Public commission to have completed a course of instruction concerning online notarization approved by the Secretary of State or the Secretary of State's authorized representative or designee and passed an examination administered by the course provider.
  3. Changes the name of the Division of Business Services of the Tennessee Department of State to the Division of Business and Charitable Organizations.
Analysis

New rules adopted by the Tennessee Department of State essentially put into the administrative rules governing Online Notaries the essential provisions of House Bill 1051 that were enacted during last year’s legislative session. The most notable requirement is successful completion of a course of instruction on online notarization and passing an examination on the course material. These new requirements apply to applicants for an Online Notary commission. Existing Online Notaries will be required to take a course when their current commissions expire and before a new one is granted.
