Effective: October 01, 2025
Chapter: 395

Summary

Senate Bill 395 no longer requires a motor vehicle certificate of title passed between individuals to be notarized by a Notary Public.

Affects

Amends Section 61-3-220 of the Montana Code Annotated.

Changes
  1. No longer requires a transfer of title of a motor vehicle between individuals to be acknowledged before a Notary Public.
Analysis

Senate Bill 380 is the second bill passed by the Montana Legislature and signed by the Governor this year to eliminate the notarization of vehicle titles transferred between individuals. House Bill 165 also did the same, but it eliminated MCA 61-3-220(b)(2) altogether, thereby striking the acknowledgment requirement before one of the named officials. Senate Bill 380 kept the subsection intact but retained the acknowledgment requirement before one of the named officials except for a Notary Public.
