AnalysisIn Oregon, an individual may sign a mental health treatment declaration if a court or two “capacity evaluators” (a licensed independent practitioner or license psychologist) determine the person is unable to make decisions for themselves because their ability to receive and evaluate information effectively or communicate decisions is impaired to such an extent that they lack the capacity to refuse or consent to mental health treatment. Previously, the declaration only had to be signed before two witnesses, but House Bill 2005 provides the option to have it notarized.
