Analysis

Senate Bill 1266 narrows in on enforcement by amending 49 O.S. 6.1 to clarify and strengthen penalties tied to violations of the prohibition on unauthorized legal advice by Notaries who are convicted for providing legal advice on a proceeding, filing, or action affecting the immigration or citizenship status of another person without a law license or authorization. 49 O.S. 6 subsection B also requires Notaries who perform nonlegal immigration assistance to satisfy specified requirements, and a violation of these provisions will also trigger the criminal penalty.
