Summary

Legislative Bill 470 authorizes unsworn declarations to be made by an attorney in certain legal matters.

Changes
  1. Provides that when a matter requires an attorney's sworn declaration, verification, certificate, statement, oath, or affidavit to support or prove something in writing, it may instead be supported by an unsworn declaration, certificate, verification, or statement signed by the attorney. This declaration must state that the information is true under penalty of perjury, and it will have the same legal effect as a sworn statement.
  2. Disallows an unsworn declaration to be made if it is a deposition, an oath of office, or an oath required to be taken before a specified official other than a Notary Public.
Analysis

The NNA recognizes that unsworn declaration provisions like this new Nebraska law are popular now and widely enacted throughout the country. This doesn’t mean that we believe society is better served with verifications, affidavits, oaths, and affirmations being made solely under penalty of perjury apart from a Notary Public performing a notarial act. The notarial act in these cases is not a mere formality but provides an additional layer of security to these oaths and affirmations.
