LA House Bill 554

Notary Law Update: LA House Bill 554

State: Louisiana

Summary:

House Bill 554 exempts the required notarial examination and answers to the notarial examination from Louisiana’s public records laws.

Signed:  June 26, 2007

Effective:  June 26, 2007

Chapter: Act No. 155

Affects:

Amends Section 44:4 of the Louisiana Revised Statutes

Changes:
  1. Exempts the required notarial examination and answers to the notarial examination from Louisiana’s public records laws.
Analysis:

Since the written records of a “public body” of the state of Louisiana are considered public records, technically the examinations of applicants for a Notary Public commission in Louisiana would qualify as a public record unless otherwise exempted. Revealing the questions and answers to Louisiana’s Notary examination, which recently became a uniform statewide test administered by the Secretary of State rather than by the separate parishes, would seriously compromise the purpose and effectiveness of this important examination.
