IA Administrative Rule (2025)
Rule/Regulation
Effective: September 10, 2025
SummaryA new administrative rule from the Iowa Secretary of State makes a slight change to the standards for identity proofing and credential analysis for remote notarial acts.
AffectsAmends Section 721-43.9(9B) of the Iowa Administrative Code.
Changes
- Requires Identity proofing and credential analysis to be performed by a third-party credential service provider whose methods and standards are substantially similar to those defined in the National Institute of Standards and Technology’s Special Publication 800-63, June 2017 edition, including the March 2, 2020, updates.
- Requires a credential for credential analysis to pass an authenticity test substantially similar to those defined in the most recent edition of the National Institute of Standards and Technology’s Digital Identity Guidelines June 2017 edition, including the March 2, 2020, updates.
AnalysisIowa’s standards for identity proofing and credential analysis have always tracked to the National Institute of Standards and Technology’s (NIST) Digital Identity Guidelines, but this new rule now specifies the June 2017 edition, including the March 21, 2020, updates of NIST Special Publication 800-63-3. Interestingly, NIST published version 4 of the Digital Identity Guidelines on August 1, 2025, so even before this new rule takes effect it is outdated and in need of revision.
