Summary

Assembly Bill 1828 changes where Notaries file their bonds from the county recorder’s office to the county clerk.

Affects

Amends Government Code Section 8213.

Changes
  1. Changes the office where Notaries file their official bond from the county recorder to the county clerk.
  2. Requires the county clerk to provide a Notary registrant with one certified copy of their bond after it is filed as proof of compliance.
  3. Provides that county clerks must set the fee for filing the bond in accordance with Government Code 54985
  4. Requires the county clerk to retain a Notary’s bond filing for 10 years.
Analysis

Assembly Bill 1828 reshuffles the deck chairs with respect to the filing of the Notary Public appointee’s official bond. Currently, the bond and oath of office are filed with the county clerk, who files the oath and sends the bond over to the recorder’s office for recordation. Beginning January 1, 2028, both the oath and bond will be filed with the county clerk. The change will be transparent to the Notary appointee. The new law has a delayed operational date to give the county clerks time to  set the fee for filing the bond. That process will be governed by Government Code 54985, which requires a lengthy process including public comment period and presentation to the county board of supervisors.
