SummaryA new administrative rule adopted by the Nebraska Secretary of State no longer requires the Notary to complete separate acknowledgment certificates for multiple signers acknowledging their signatures to an Electronic or Online Notary.

Changes
- Repeals the provision stating that each electronic signature presented for notarization and attestation in the form of an acknowledgment is to be individually affixed to the electronic document by the principal signer and should be acknowledged separately by the principal signer, except when the notarized record is executed on behalf of any foreign or domestic corporation, non-profit corporation, professional corporation, limited liability company, unincorporated association or partnership, or business trust, estate, partnership, trust; or the United States, any state, or any foreign government.
- Repeals an identical provision related an online notarial act.
- Makes technical, non-substantive changes.
AnalysisThe Nebraska Secretary of State makes rules changes that repeal the requirement for separate attestations for multiple principals during in-person electronic and online notarial acts.
The repealed rule required separate certificates of acknowledgment to be completed for each principal signing the document and acknowledging their signature to the Notary. The same rule did not apply to traditional notarial acts because the Notary could enter the names of multiple principals acknowledging their signatures at the same time into the same acknowledgment certificate.
The statement of the Secretary of State for why these rules were repealed said that actual practice of electronic and online notarization has shown the requirement for separate attestations for multiple principals during electronic or online notarizations is no longer needed. Evidently, because an electronic and online notarization system generates the notarial certificate and populates it with the names of principals, the rule is outdated.
