WY House Bill 36 - House Bill 36 enacts the Uniform Law on Notarial Acts, a model notarial law promulgated by the National Conference of Commissioners on Uniform State Laws in 1982, and repeals the former Wyoming Acknowledgment Act and several other statutes governing the acceptance of acknowledgments performed by notarial officers of other U.S. states and jurisdictions.

UT House Bill 26 - House Bill 26 changes the definition of “satisfactory evidence of identity” by adding clarifications on the written forms of ID a Notary may accept and disqualifying certain IDs which do not properly constitute satisfactory evidence. House Bill 26 also revises the required elements which must appear on the Notary’s official seal, and the elements from the seal which must be added to a plat map or electronic acknowledgment notarized without affixation of an image of the seal. Finally, House Bill 26 also makes changes in procedures for a Notary reporting an address and name change.

Certain activities of Notaries are directly affected by the new law.

LA Senate Bill 709 - Senate Bill 709 requires Notaries in Orleans Parish to record every original authentic act, contract, and instrument except a chattel mortgage, an act relating to immovable property outside of Orleans Parish and a money judgment in the notarial archives of the parish before being recorded in the office of recorder of mortgages and register of conveyances. The bill also requires registration of an act of sale or transfer of “immovable” property (real estate) within 48 hours.

MN House File 3516 - Minnesota enacts the Uniform Real Property Electronic Recording Act effective July 1, 2008, and establishes an Electronic Real Estate Recording Commission to promulgate standards for electronic recording in the state. H.F. 3516 also repeals the former electronic recording pilot program that was operative in the state since 2000.

ID Senate Bill 1335 - Idaho enacts the Uniform Power of Attorney Act (UPOAA). If a power of attorney is presented for notarization, a Notary will need to know that a signer may sign the power of attorney or may direct another person to sign it for him or her. The Act doesn’t require a power of attorney to be notarized, but a court will presume the signature to be genuine if it is acknowledged before a Notary or an officer authorized to take acknowledgments.

SC House Bill 4400 - While House Bill 4400 addresses many other facets of immigration, it has particular provisions addressing the business of immigration assistance service providers by defining the duties of non-attorneys who provide certain non-legal and ministerial services; regulating the ethical conduct of immigration specialists; and authorizing the Director of the South Carolina Department of Labor, Licensing and Regulation to investigate and enforce the provisions of the chapter. In many respects House Bill 4400 is similar to a Georgia law enacted earlier this year.
