Summary

Senate Bill 3195 adjusts certain fees that county clerks may charge Notaries, among many other fee adjustments for county clerks.

Affects

Amends Section 8-21-701 of the Tennessee Code Annotated.

Changes
  1. Raises the fee for recording a Notary’s official bond from $1.50 to $2.00; and for certifying a Notary’s election to the Secretary of State from $5.00 to $7.00.
  2. Reduces the fee from $7.00 to $5.00 for receiving and forwarding to the Secretary of State notification of a Notary’s change of name or address.
Analysis

In Tennessee as in many states, the legislature must act to adjust the fees charged by county clerks for its services. Senate Bill 3195 raises the fee for filing a Notary bond from $1.50 to $2.00 and states that a county clerk may charge $5.00 for receiving and forwarding notification of a Notary’s change of name or address. There is an apparent discrepancy in the this latter amount and the fee specified by TCA 8-16-109, where the statute says the fee to be charged is $7.00, 2.00 of which must be forwarded to the Secretary of State. Perhaps Senate Bill 3195 simply attempts to clarify the amount the county clerk can retain.
