Summary

Amended rules adopted by the South Dakota Secretary of State updates the Notary commission and change forms.

Affects

Amends Sections 5:04:03:01 and 5:04:03:04 of the South Dakota Administrative Rules (SDAR).

Changes
  1. Strikes references to the Notary bond in SDAR 5:04:03:01.
  2. Strikes the bond section from the Notary Public commission application form.
  3. Lists the required contents of the Notary Public commission application form.
  4. Lists the required contents of the Notary change form.
Analysis

Earlier this year, the South Dakota Legislature passed, and the Governor signed, House Bill 1133, repealing the $5,000 Notary Public bond requirement. This rule change implements those changes in rules specifying the information that must be provided in the Notary Public commission application and Notary change forms.

The rules are provisionally effective on September 29, 2025, and are finally effective July 1, 2026.
