Changes
Notary Commissions
- Clarifies that an application for a Notary commission must include the applicant’s residence (formerly mailing) address.
- Provides that the Secretary of State will collect $67.54 for an initial or reapplication for a Notary commission, and $1.83 for electronic payment processing.
- Provides for a duplicate commission certificate, the Secretary of State will collect $7.50 and an additional $.055 for electronic payment processing.
- Provides that for continuing education the Secretary of State will collect $48.02 and $1.35 for electronic payment processing.
- Provides that for a Remote Notary application, the Secretary of State will collect $92.05 and $2.31 for electronic payment processing.
Apostilles and Authentications
- Defines "apostille authentication."
- Stipulates the information, as specified, that is required for a request for an apostille authentication.
- States the grounds, as specified, for the Secretary of State to refuse a request for an apostille authentication.
- Provides that if the Secretary of State refuses a request for an apostille authentication the Secretary must not later than 10 business days after the filing, return the document or notify the person who submitted the request an provide a brief explanation of the reason for the refusal.
- Provides that the Secretary of State will adopt a format for apostille authentications that is consistent with the Trilingual Model Apostille Certificate maintained by the Hague Conference on Private International Law.
- Provides that the format for an apostille authentication will be used for all Hague Apostille Convention Treaty nations as well as those that have not joined the Convention.
- Requires the apostille certificate must include a statement to facilitate the use of the certificate in foreign countries that have not ratified or adopted the Hague Apostille Convention.
Other Provisions
- Provides that the Secretary of State will collect $1,500 for a remote technology vendor application.
- Makes technical changes.
AnalysisIn the Indiana Secretary of State’s most recent administrative rule filing, the Secretary lists the specific fees that will be assessed to applicants of Notary commissions, remote Notary registrations, and remote technology vendor applications. The new rules also outline new procedures for apostilles and authentications. Most notably, a new rule indicates that the Secretary of State will adopt the same apostille certificate for nations that are party to the Apostille Convention as well as those that are not.
