Changes - Provides that prior to offering an educational course to satisfy the mandatory education requirement, a vendor must obtain a certificate of approval from the Secretary of State for each course of study offered and further provides rules to implement this requirement.
- Provides that to apply for a certificate of approval from the Secretary, a vendor must submit a lesson plan that complies with the standards in the new rule.
- Provides the procedures for curing a deficient application or lesson plan submitted by a vendor.

- Requires an approved vendor to respond in writing within 30 business days of receiving a written request from the Secretary for information relating to a course of study.
- Requires an approved vendor to disclose the vendor's refund policy prior to charging any fees for courses. to applicants and provides rules to implement this rule.

AnalysisThe California Secretary of State adopts regulations for Notary education vendors concerning the mandatory education requirement. Assembly Bill 2062 of 2004 delayed by six months the effective date of the mandatory education requirement to allow the Secretary to publish regulations to implement the education requirement. All Notary applicants who are appointed as a Notary on or after July 1, 2005 must have taken a 6-hour course of study.
