Analysis

In West Virginia, the Legislature must approve of administrative rules before they are finally adopted. The Legislature’s approval of the Secretary of State’s rules for remote ink signed notarization during states of emergency like COVID-19 completes a process that began last Spring when the emergency rules were published.

Now that Senate Bill 469 has been signed into law, the approval of the rules for the long term may be moot, since SB 469 also authorizes remote ink signed notarization.
