MO Administrative Rules 2021 (Notary Commissions)

Summary
The Missouri Secretary of State adopts permanent rules related to Notary commissions and the Notary complaint process.
Affects
Amends 15 CSR 30-100.005, 5 CSR 30-100.010, and 5 CSR 30-100.015.
Changes
  1. Modifies the title of 5 CSR 30-100.010 to read "Approval, Revocation and Suspension of Notary Commission."
  2. Provides that an individual who has been convicted of a felony involving dishonesty or moral turpitude, committed in the last five years, will be denied approval for a commission.
  3. Modifies the title of 15 CSR 30-100.015 to read "Request for Hearing on Suspension or an Appeal on Denial of an Application."
  4. Provides that an applicant who has been denied a Notary commission may appeal the denial to the Director of Business Services or his or her designee, and further provides that this appeal does not include a right to a hearing.
  5. Provides procedures, as specified, for filing a complaint against a Notary.
Analysis
These permanent rules were adopted as emergency rules last year after Missouri's big Notary bill (HB 1655) was enacted. The permanent rules were adopted as promulgated in the emergency rules.
