Analysis

House Bill 2606 authorizes the Secretary of State to promulgate rules and regulations establishing procedures for electronic notarization. Earlier in the 2004 legislative session, a bill adopting many provisions of the Model Notary Act and authorizing the Secretary of State to issue regulations for electronic notarizations was defeated. While this bill omits the MNA provisions, it does allow the Secretary to issue eNotarization regulations. The bill amends Kansas' Uniform Electronic Transactions Act, not the Notary statutes in Chapter 53 of the Kansas Statutes Annotated.
