Summary

Senate Bill 324 prohibits a Notary from taking an acknowledgment of an estate division agreement using remote notarization.

Amends Section 3-95b of the Connecticut General Statutes.

Changes
  1. Provides that the execution of an agreement as to the division of an estate under CGS 45a-434 may not be acknowledged remotely before a Notary pursuant to CGS 3-95b(b).
Analysis

When Connecticut enacted remote notarization in 2023 (Senate Bill 1040), we noted at the time that the law prohibits Notaries from performing remote notarizations on the most important types of documents that one would want to be notarized, such as trusts, wills, powers of attorney, and documents for a real estate closing. Senate Bill 324 adds an agreement as to the division of an estate under CGS 45a-434 to the list of prohibited documents for which remote notarization is not allowed
