CO House Bill 24-1381

State: Colorado
Signed: June 03, 2024

Effective: August 07, 2024
Chapter: 350

House Bill 24-1381 makes clarifying amendments to a statute on notarial conflicts of interest involving documents acknowledged by a savings and loan association.

Amends Section 11-41-128 of the Colorado Revised Statutes.

  1. Makes stylistic amendments to CRS 11-41-128 to clarify that a Notary or notarial officer is not disqualified from taking the acknowledgment or proof of an instrument in which a savings and loan association is interested due to the Notary's or other public officer's employment by, or the Notary or public officer being a member or officer of the savings and loan association.

The purpose of House Bill 24-1381 is to make technical amendments to a statute on conflicts of interest that make it clearer. The sense of the statute is unchanged. The statute more clearly states that a Notary or other officer authorized to take acknowledgments or proofs is not disqualified from performing the notarial act in which a savings and loan association is interested because the Notary or officer is employed by or a member of the association.
