  1. Allows a Notary to charge as a travel fee the prevailing rate for mileage established by the Internal Revenue Service for business travel and a fee not to exceed $5 for travel to perform a notarial act.
Analysis

A revised regulation adopted by the Secretary of State and effective August 13, 2018 revises the amount for which a Notary may be reimbursed per mile for traveling to perform a notarial act. The Notary fee statute (ACM St. Gov. 18-112[a]) sets that amount at 19 cents per mile, or a higher amount set by regulation of the Secretary of State. This regulation takes advantage of this rulemaking authority and effectively future-proofs the amount for mileage by indexing it to the current IRS mileage rate for business travel. Currently in 2018, that amount is 54.5 cents per mile. In addition, a Notary may charge the additional flat fee of $5.
