Summary

Senate Bill 92 clarifies that the statewide examination must be held not less than twice per year and allows the Secretary of State to select when to administer it.

Affects

Amends Section 35:191(C)(3) of the Louisiana Revised Statutes.

Changes
  1. Requires the Secretary of State to administer the statewide examination for Notary commission applicants not less than twice a year. Note: the previous statute limited the examination to being held twice per year.
  2. No longer requires the examination to be scheduled on the first Saturday of June and December, but allows the Secretary to determine the dates for the exam.
Analysis

Senate Bill 92 no longer requires the statewide Notary examination to be administered twice a year, but now states that it must be offered not less than twice. This allows the Secretary to possibly schedule more than two examinations a year. Since under the prior law the examinations were held on the first Saturdays in June and December, many applicants who did not pass would have to wait another six months before sitting for the next exam. SB 92 also no longer requires the examination to be administered on these specific Saturdays but allows the Secretary to determine the exam dates.
