Summary
The Maryland Secretary of State has published regulations for Notary Public education providers.
Affects
Adds Sections .13 through .17 to Title 01, Subtitle 02, Chapter 08 of the Code of Maryland Regulations.
Changes
  1. Provides the requirements, as specified, for an application for authorization to provide a Notary Public course of study and examination.
  2. Provides the qualifications, as specified, for Notary Public course and examination providers.
  3. Provides the requirements, as specified, for the Notary Public examination and passing score that is incorporated into a course of study.
  4. Requires Notary Public course and examination providers to offer a virtual or in-person course of study.
  5. Requires Notary Public course and examination providers to provide each applicant a certificate of completion at the end of the course of study.
  6. Requires Notary Public course and examination providers to provide certain information, as specified, to the Secretary of State.
  7. Sets the standards and content requirements, as specified, for the Notary Public course of study and examination.
  8. Provides the rules for revocation of a Notary Public course and examination provider approval.
Analysis

Effective October 1, 2021, Maryland will require all applicants for a Notary Public commission to take a course of study on Maryland laws governing Notaries Public and the performance of notarial acts and pass an examination. The Secretary of State will be approving course providers to offer this course and examination. The administrative regulations adopted on August 31, 2021, that are summarized in this new law update will apply to providers of the course and examination.
