Summary

  1. Adopts without changes the temporary rules for notarial acts involving remotely located individuals that were previously adopted on January 2, 2020.
Analysis

Idaho enacted the Revised Uniform Law on Notarial Acts provisions for notarial acts involving remotely located individuals (Chapter 160 of 2019 [Senate Bill 1111]) that took effect on January 1, 2020. On January 2, 2020, the Secretary adopted temporary rules to implement the new statutes. The Secretary of State proposed to make these temporary rules permanent by filing a notice of rulemaking on October 20, 2021, and the Idaho Legislature was required to approve the rules before it adjourned sine die on March 31, 2022. The Legislature did not approve the rules, so they took effect upon adjournment.
