New State Laws Initiate Major Changes to
Notarial Duties
New Journal Law
Effective July 1, 2009

Senate Bill 111 mandates a new journal record requirement for every notarial act, and if required, the providing of a certified copy or certificate of any journal record or Notary act. All Notaries must comply.

New Commission Law and Rules
Effective May 15, 2009 and July 1, 2009

New rules in effect May 15, 2009 increase the Notary commission and authentication fees.

Other rules affected by Senate Bill 111 and effective July 1, 2009 include new Notary Public application and commission requirements. The law allows state officials to put in place rules requiring education and testing for all Notaries, and empowers the Secretary of State to issue a “letter of admonition” or suspend a Notary commission for certain misdeeds.

New Colorado Law Bolsters Record Keeping, Education

COLORADO — The centennial state has long required records to be kept for some notarial acts, but a new state law expands that mandate to include all notarizations, joining a growing national trend toward stronger recordkeeping and accountability.
