Nevada Enacts New eNotarization Law

The Nevada Secretary of State now has the authority to appoint electronic Notaries following the enactment of the state’s eNotarization law, which took effect July 1. The bill, also known as the Electronic Notary Public Authorization Act, contains comprehensive guidelines and educational requirements for eNotarization.

The bill creates a separate appointment for electronic Notaries. To be eligible for an electronic Notary appointment, a Notary must have at least four years’ experience as a regular commissioned Notary, and must maintain their traditional commission as well. The new law also requires completing a mandatory education course and posting a separate $10,000 bond for the new appointment. The Notary Division of the Secretary of State’s office is currently developing the mandatory course and guidelines.

Nevada’s Electronic Notary Public Authorization Act draws heavily from the National Notary Association-authored Model Notary Act.
